The big news for the real estate industry, as you may have heard or been reading about, is the NAR/DOJ settlement that went into effect on August 17th. In a nutshell, commissions have been "decoupled", intent is to have buyers pay their own agent. Sellers continue to have the discretion to offer compensation to buyer’s brokers, as they always have. The settlement does not restrict this ability.
Commissions have always been, and will remain, a matter of transparent negotiation with our clients. Although the buyer's agent commission can no longer be displayed on the MLS, it can still be negotiated outside of the MLS.
All buyers represented by a NAR-affiliated agent are now required to sign a Buyer Representation Agreement, formalizing their relationship with the broker before touring properties—a practice that has been mandatory in many states for over a decade.
